Falck Healthcare’s processing of Personal Data in Relation to Third Parties

In connection with the cooperation between you/the company you represent and Falck Healthcare A/S "Falck," Falck, as the data controller, collects and processes certain personal data about you. In this privacy policy, we describe the processing, use, and disclosure of your personal data.

The privacy policy covers the following groups of individuals:

  • Non-customers: If you are in contact with Falck without being a customer, Falck may store information about you, depending on the form of communication used. This may be the case, for example, if you send an email to Falck or are otherwise in email dialogue with Falck, contact Falck via an online form, or call Falck.
  • Customers: Including contact persons representing the customer (including private individuals who sign up for Child and/or Cohabitant/Spouse coverage).
  • Partners and suppliers (e.g., insurance brokers, etc.).
  • Employees at Falck: In contexts not related to their employment at Falck, e.g., posts on LinkedIn.

1. Why does Falck process your personal data in connection with customer contact?

As part of the contact with Falck, e.g., when entering into contracts or providing services to Falck, Falck will process personal data about you for various reasons. Here you can see on what basis and for what purposes Falck will process your data:

  1. Manage our relationship with you, e.g., in our customer system and perform preparatory activities or to comply with an existing contract.
  2. Maintain the relationship with the company you represent.
  3. Newsletters.
  4. Support the possibility for you as a customer to manage "enrollment and disenrollment" of covered individuals in your scheme with Falck and to request selected services on behalf of employees.
  5. Posts on Falck’s official LinkedIn profiles, instructional videos, etc.
  6. LinkedIn Sales Navigator.
  7. Where relevant, to comply with legal obligations such as:
    1. To ensure the quality and IT security of Falck's processes and applications.
    2. To comply with our obligations and your rights under data protection law, including GDPR.
    3. To defend or prove a legal claim.

2. What personal data does Falck process about you?

Falck only processes the personal data about you that is necessary to fulfill the purposes described in point 1 of this privacy policy. These personal data may, to the extent relevant to your specific service, include the following categories of information:

  1. Name
  2. Contact information, such as phone number, email, etc.
  3. Job title and workplace
  4. Payment information

3. On what grounds and for how long does Falck process your personal data?

For Falck to process your personal data for the purposes described under point 1, Falck must have a legal basis for the processing. Relevant legal bases for processing the personal data are found in the EU's General Data Protection Regulation (GDPR) and the Danish Data Protection Act.

Falck must also determine how long it is legitimate and proportionate to retain your personal data, ensuring that your personal data is never stored by Falck longer than necessary to fulfill the original purpose of the processing.

In accordance with GDPR,  Falck uses the following legal bases to process your personal data:

  1. Consent, art. 6(1)(a)
  2. Contractual necessity, art. 6(1)(b)
  3. Legitimate interest, art. 6(1)(f)

The national laws that Falck's processing of your personal data is based on during processing and storage are:

  1. The Limitation Act
  2. The Data Protection Act

Falck will process your personal data for different periods, depending on the legal basis for the processing. This period will vary depending on the purpose.

4. Automated individual decisions

Your personal data is not processed for automated individual decision-making or profiling.

5. Who does Falck share your personal data with?

To the extent necessary, Falck will share information about you with a number of recipients ('third parties') in order to provide you with a service based on the purposes specified under point 1. These third parties will be independent data controllers with respect to their processing of your personal data.  

The third partiers we share your personal data with are:

  1. Falck Danmark A/S

In addition to these third parties, Falck will also share your personal data with a number of suppliers ('data processors'), who will process your personal data based on instructions from Falck. These data processors are primarily located within the EU/EEA, but there may be transfers to countries outside the EU/EEA ('third countries'), such as India and the USA, as Falck uses IT services with support functions in these countries. 6. Your rights

In connection with Falck's processing of your personal data, you have certain rights that you can exercise if you wish. You have, among other things, the right to:

  • Access and receive a copy of the personal data that Falck processes about you
  • Within the limits of the law, request Falck to delete the personal data that Falck processes about you
  • Rectify incorrect or incomplete personal data about you
  • Within the limits of the law, restrict Falck's processing of personal data about you
  • Data portability
  • Object to Falck’s processing of your personal data

In addition to the above rights, you also have the right to file a complaint about Falck's processing of your personal data with the national data protection authority in Denmark, 'Datatilsynet.'
